The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Qatar. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Most interactive websites use cookies to let us retrieve the user’s details for each visit.   2. Responsibility for User Content: We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any User Content. We disclaim any responsibility or liability for any User Content, including but not limited to errors, defamatory statements, or illegal content.

User Content must not include material that promotes hate speech, violence, illegal activities, or explicit content. We reserve the right to remove content that we consider harmful or offensive.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to WEYA ART. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Approved organizations may hyperlink to our Website as follows:

  • By use of our corporate name; or

No use of WEYA ART logo or other artwork will be allowed for linking absent a trademark license agreement.

Content Liability

We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. WEYA ART, a fully-owned subsidiary of WEYA ART TRADING W.L.L (“WEYA ART,” “we,” or “our”), offers a platform for viewing, selling, and purchasing original works of art, as well as commercially exploiting digital images of artworks through our website, accessible at www.weyaart.com (the “Site”), or via our mobile application (the “Mobile Application”). This includes any associated services, software, tools, features, or functionalities provided by WEYA ART (individually referred to as a “Service” and collectively as the “Services”). Please carefully review the following terms and conditions (“Terms”) along with our Privacy Policy, available at Privacy policy (the “Privacy Policy”). These Terms, the Privacy Policy, and any other policies referenced herein, govern your access to and use of the Services and form a binding legal agreement between you and WEYA ART.

Certain sections of the Services and your access to specific features may entail distinct terms and conditions. In the event of any inconsistency between these Terms and the terms and conditions governing a particular Service area or feature access, the latter shall prevail regarding your use or access to that area or feature of the Services.

Please carefully review these Terms, as they encompass an arbitration agreement. By accessing or utilizing the Services, you are consenting to resolve any disputes related to your use of the Services through binding individual arbitration, foregoing litigation in court. Should you wish to opt-out of this arbitration agreement, you may do so by following the outlined procedures in the “Agreement to Arbitrate” section below. Additionally, the dispute resolution section includes a waiver of class action, necessitating individual dispute resolution rather than participation in proposed class actions. These Terms also entail a waiver of your right to a trial by jury, irrespective of your agreement to arbitrate claims.

By accessing or using the Services, or engaging in transactions such as selling or purchasing works through the Services, or posting content on the Services, you acknowledge and agree to be bound by these Terms. Your registration status with the Services does not alter this agreement. If you do not consent to these Terms and the accompanying Privacy Policy, you are not authorized to access or use the Services.

If you accept or agree to these Terms on behalf of a company or another legal entity, you certify that you possess the requisite authority to legally bind that entity to these Terms. In such circumstances, the terms “you” and “your” shall pertain to and apply to that company or legal entity.

Modifications to these Terms

WEYA ART reserves the unilateral right to alter, discontinue, or terminate the Services, or to amend these Terms, without prior notice, at its discretion. In the event of modifications to these Terms, we will either publish the changes on the Services or notify you directly. The “Last Updated Date” will also be revised accordingly. By persisting in accessing or utilizing the Services subsequent to the publication of a modification on the Services or receipt of notification regarding a modification, you are affirming your consent to abide by the revised Terms. Should the revised Terms prove unacceptable to you, your sole recourse is to discontinue use of the Services. We advise you to periodically revisit these Terms for review.

Changes to the Services

We retain the authority to alter the URL, adjust, discontinue, restrict, or block access to the Services without prior notification. Furthermore, we reserve the right to modify or eliminate any Original Works of Art, Digital Works, WEYA ART Content, or Member Content from the Services without notice, including the removal of any artwork or content deemed inappropriate or objectionable by our standards.

Periodically, information on the Services may contain typographical errors, inaccuracies, or omissions. We hold the right to rectify any such errors, inaccuracies, or omissions and to update or change information as necessary without advance notice. While we are committed to compliance with applicable laws, regulations, or statutes, we do not pledge to continuously update, amend, or clarify information on the Services, unless required by law. The absence of a specified update or refresh date does not imply that all information on the Services has been revised or updated.

WEYA ART reserves the right to change, eliminate or update any service provided.

Eligibility

The Services are intended solely for persons who are 18 or older. Any access to or use of the Services by anyone under 18 is expressly prohibited.

Account Creation for Artists:

To establish an account with WEYA ART, prospective artists must complete a form providing personal details and create a unique username and password. It is the artist’s responsibility to safeguard this password and refrain from sharing it with any third party. All information submitted must be accurate and genuine. Additionally, submitted artwork samples must be of high resolution and created and owned solely by the artist. Following the submission of the application, admission to WEYA ART remains at our discretion. We evaluate the information provided to determine acceptance into membership. Please note that membership is not confirmed until the required payment fees are received into the WEYA ART bank account.

Account Creation for Art Buyers:

To establish an account with WEYA ART, Buyers must complete a form providing personal details which includes but is not limited to username, password, address, a valid email, and a valid payment term. All information submitted must be accurate and genuine. It is the responsibility of the buyer to safeguard the password and username and not to share it with any other party. Prior to completing the form, Buyers must agree to the terms and conditions as well as the policies of our website. WEYA ART reserves the right of admission, and we are entitled to delete, block, or eliminate any account under any circumstances and for any reasons.

Listing works with WEYA ART

As an Artist member, you will submit your Original work through your dashboard for further evaluation and approval. It is imperative that you are the rightful owner and creator of the submitted artwork. Each artwork must be accompanied by a Certificate of Authenticity issued by the Artist in the name of the Buyer. Upon submission, you are required to provide comprehensive information about the artwork, ensuring its accuracy and authenticity. Please note that WEYA ART bears no responsibility for any discrepancies between the Original artwork and its description on our website. Following the submission of artwork for evaluation, you can expect to receive an approval or denial within 3 to 5 working days. Artworks that do not align with WEYA ART standards, violate Qatar laws, display low ethical or moral standards, or contain explicit sexual or political content are prohibited on our website.

WEYA ART retains the authority to approve, deny, delete, or remove any artwork without prior notice and for any reasons deemed appropriate.

In the event that an artist is unable to provide artwork that complies with our standards, WEYA ART reserves the right to continue benefiting from the registration fees until their expiry date. Should we not receive any cancellation requests via email from the artist, the registration fees will be automatically renewed.

You acknowledge that WEYA ART retains the prerogative to promote and market Original Works of Art and/or Digital Works by implementing sales and discounts. Such promotional offers will affect the listing price of Original Works of Art and/or Printed Works related to Digital Works. However, you always maintain the right to remove a listing for an Original Work of Art or Digital Work from the Services.

Should you wish to remove a listing for an Original Work of Art or Digital Work from the Services, you must access your account and your dashboard. From there, select the image you wish to delete and click on the “Delete” option, following the instructions provided on that page. Responsibility of Works

You acknowledge and agree that you bear sole responsibility for all artworks, irrespective of their type, posted on our website from your account. You guarantee that you are the exclusive creator and owner of the artworks published in your account on our website. Additionally, you acknowledge and guarantee that all information provided in the description of each artwork or in the artist profile or in the artist Dashboard is accurate and true.

For Digital artworks, you agree, guarantee, and acknowledge that you possess all necessary rights, licenses, consents, and releases required to grant WEYA ART the rights to such Digital Works as outlined in these Terms. Furthermore, you affirm that neither the Original Works of Art nor Digital Works made available through the Services, nor WEYA ART’s use and exploitation thereof as detailed in these Terms, will infringe upon, misappropriate, or violate any third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, nor result in the violation of any applicable law or regulation.

It is solely the responsibility of the artist to inform WEYA ART in the event they are not the sole owner of the artwork, whether original or Digital. A written notice, sent via email and signed by the artist, must be submitted to [email protected]  prior to uploading the artwork on their dashboard for approval. This notice should include the name, information, and picture of the artwork, stating that the artist grants WEYA ART the right to sell, use, and showcase the artwork through social media or any other medium for any purpose.

Online Sales

When submitting listings for Original Works of Art, you are engaging in the sale of these works through the Services and on third-party websites and sales channels (collectively referred to as “Online Sales”). By doing so, you grant WEYA ART a worldwide, transferable, nonexclusive right and license, with the ability to sublicense, to: (i) utilize, reproduce, distribute, publicly perform, and publicly display copies of the Original Works of Art sold via the Sales Channels; and (ii) access, view, use, crop, resize, copy, distribute, license, publicly display, publicly perform, transmit, and broadcast copies of the Original Works of Art in any form, medium, or technology now known or developed in the future for the purpose of promoting WEYA ART and its Services.

You acknowledge and agree that the aforementioned license rights are provided on a royalty-free basis and that your sole compensation for granting such license rights, if any, will be in the form of the Artist Revenue Share (as defined below), which is payable solely upon the sale of an Original Work of Art via the Online Sales channel.

In the case of submitting listings for Digital Works, you will authorize Members and other third parties to purchase fine art reproductions of the Digital Works (collectively referred to as “Printed Works”) through a print-on-demand service.

In the event that an Original Work of Art and/or Printed Works are sold through a third-party website, the terms and conditions specified by the third-party website will govern the purchase made by the respective buyer through that platform. However, in the relationship between you and WEYA ART, these Terms will remain applicable to the sale of such Original Work of Art and/or Printed Work.

WEYA ART and/or its designated third-party service providers will assume responsibility for gathering billing and shipping details from the purchaser and for processing payments for these purchases through the Services. For transactions conducted via third-party websites and Offline Sales, the relevant third-party website or WEYA ART’s Offline Sales partner will handle the collection of billing and shipping information from the purchaser, along with payment processing. They will also transfer applicable payments related to these sales to WEYA ART, as agreed upon between WEYA ART and the respective third-party website or Offline Sales partner, while sharing pertinent shipping information, including purchaser contact details if necessary, with WEYA ART.

WEYA ART assumes responsibility for ensuring that the artwork reaches its final destination once the artwork fees have been received into the designated account. It is the artist’s responsibility to provide the correct artwork, which corresponds to the one purchased by the client. Furthermore, the artist is accountable for adequately packaging the artwork to safeguard it from any potential damage during the shipping process. Alongside the artwork, the artist must include a Certificate of Authenticity addressed to the client who has purchased the artwork.

The artist bears the responsibility of ensuring that the artwork is free from damages and accurately matches the state as published on the website, adhering to the provided picture and description. In the event of any discrepancies, damages, or incorrect artworks discovered upon shipment, the shipment will be returned. The artist will be liable for covering any expenses incurred by WEYA ART, as well as any charges related to client compensation or shipping costs.

You agree to comply with the terms and conditions of WEYA ART’S then-current Return Policy that are applicable to any Work of Art that are sold through the Services.

The Artist acknowledges and agrees that payment for the corresponding artwork will be transferred to their account once the return period has expired, typically after 7 working days. This payment will be transferred, deducting WEYA ART’s percentage for selling the artwork (mentioned and agreed upon registration) and any additional expenses incurred.

WEYA ART reserves the right to modify the agreed sales percentage, providing a prior notice of 5 working days. An official email will be dispatched to your registered email address, and an announcement will be posted on the Artist Dashboard, informing you of the updated fee.

The Artist acknowledges and accepts that in the event of failure to pay the registration fees, WEYA ART is entitled to eliminate, close, or deactivate their account.

The artist acknowledges and accepts that should our system fail to renew the registration package after three attempts, the account will be automatically deactivated. In such a scenario, the artist will incur an outstanding balance equivalent to one registration fee. If the artist wishes not to renew their package with WEYA ART, they must send an email notifying us at least 10 working days prior to the package expiration. Failure to do so will result in the automatic renewal of the registration and subsequent deactivation of the account.

Social Media

The artist understands, accepts, and acknowledges that WEYA ART will use the artist’s picture, artworks, videos, ideas, and any related information for marketing purposes, both online and offline. By registering on our website, the artist grants WEYA ART permission to use any information related to the artist or their artworks for marketing or sales generation purposes.

Artwork Availability

The Artist is responsible for indicating the availability of their artworks in their dashboard. If an artwork is no longer available, the artist must immediately update its status to “out of stock” or “sold.” in the event of WEYA ART receiving an order for an unavailable artwork, either online or offline, WEYA ART will cancel the order, return the payment to the purchaser, and charge the artist a penalty of 1,000 QAR for not keeping their profile updated.

 Artist Agreement to Return Policy

The artist agrees, acknowledges, and accepts our return policy, understanding that there may be cases when a client returns an artwork for various reasons.

Returns Due to Damage:

  • If a client returns an artwork due to damage, and the shipping company verifies that the damage was not caused during delivery, the artist will be responsible for the delivery and return costs of the item.
  • The artwork will be removed from the artist’s profile.

Repeated Damage Incidents:

  • If damage to the artwork is reported and proven to have occurred prior to shipping on three separate occasions, WEYA ART reserves the right to blacklist the artist and deactivate their account. Note that the subscription fees will continue until the end of the current term.

At WEYA ART, we are committed to maintaining high standards of quality and service for our customers and artists. We appreciate your cooperation in ensuring that artworks are delivered in excellent condition.

Admission Policy Explanation

At WEYA ART, we take pride in maintaining a community of professional and high-standard artists who align with our vision of excellence in the art world. To ensure that we uphold this standard, we reserve the right to accept or decline any request to join our platform.

Our selective admission process is designed to ensure that we work with artists who demonstrate exceptional skill, creativity, and professionalism. This allows us to offer our clients a curated selection of artworks that meet the highest quality standards.

Purchaser Terms and Conditions

  • Purchase of an Artwork from our website
  • Purchase of Prints or Digital Art.
  • Order Cancellation

Purchase of an artwork from our website

As a purchaser member, you are entitled to buy any artwork listed on our website. However, you acknowledge, accept, and agree that your purchase is from the member identified on the listing for that work, not from WEYA ART. Prices, descriptions, and availability are stated on our website, but in the event that an artwork is unavailable, out of stock, or sold but still listed as available, WEYA ART will return your full payment within 3 working days. You accept, agree, and acknowledge that WEYA ART is not responsible for updating the artist profiles and therefore has no control over the availability of the artworks.

Prices for Artworks are as specified on the checkout. You acknowledge that these prices do not include shipping and handling charges (unless specifically indicated on the Site) or applicable taxes, including VAT, for which you are responsible. These additional charges will be separately identified on your receipt. WEYA ART and/or its third-party service providers will collect your billing and shipping information and process your payment.

The purchaser agrees and acknowledges that certain artworks may require special shipping methods due to their size or material. Consequently, shipping costs may vary depending on the nature of the artwork.

Purchase of Prints or Digital Artworks.

As a purchaser member, you are entitled to buy any artwork listed on the WEYA ART website. However, when purchasing prints or digital art, you are not entitled to re-print, duplicate, or re-sell them under any circumstances.

Order Cancellation

WEYA ART reserves the right to cancel any order for any Artwork or digital Work placed via the Services if WEYA ART determines, in its reasonable discretion, that the item is mispriced, out of stock, discontinued, or otherwise unavailable at the price listed via the Services. If WEYA ART cancels an order placed via the Services, WEYA ART will send you an email confirmation of such cancellation and your payment will be returned.

Art Transaction Agreement:

If you are a member who has listed an artwork or digital work and another member contacts you through the Services to purchase the listed item, a similar work, or a custom piece related to the listed work, you may not sell such artwork or digital work to that member independently of WEYA ART and the Services. Likewise, if you are a member wishing to purchase an artwork or digital work listed by another member, or a similar work or custom piece, you may not buy it independently of WEYA ART and the Services.

Violating this provision may result in the termination of your member account as an artist or buyer, along with any other remedies available to WEYA ART, including but not limited to, injunctive or other appropriate relief.

Artwork Color
You acknowledge and agree that WEYA ART makes commercially reasonable efforts to accurately display the colors of Artworks, Digital Works, and Printed Works through the Services. However, due to variations in individual computer monitor settings, WEYA ART cannot guarantee the color accuracy of any Artworks, Digital Works, or Printed Works displayed on the Services and disclaims all liability for any discrepancies in this regard.

Member Content

You acknowledge and agree that you bear sole responsibility for any Member Content you provide on or through the Services. You affirm and guarantee that: you hold exclusive ownership rights to all Member Content you provide on or through the Services, or you possess all necessary rights, licenses, consents, and releases required to provide such Member Content and grant all rights and licenses as outlined under these Terms; and the Member Content, your provision of any Member Content on the Services, or any permitted use of any Member Content under these Terms will not infringe upon, misappropriate, or violate any third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, nor rights of publicity or privacy, or breach any applicable law or regulation.

“Make an offer” Terms and conditions:

For each sold artwork, a “Make an Offer” option will be available alongside the artwork, enabling buyers to submit bids. However, if the artist removes the work from the site, it will no longer be eligible for resale offers. In addition the purchaser will not be entitled to make a bid for more than 30% less than the listed price.

To submit an offer for an artwork, the purchaser must complete a form specifying the offer amount they wish to make.

All resale orders are final unless the artwork arrives damaged. In the event of damaged artwork, the order will undergo the same refund process as with any regular order. If the work is determined to be beyond repair or restoration, then you will be eligible for a refund.

On the event the artist agrees on the bid the discounted percentage will be deducted from the artist account. WEYA ART will be entitled to receive its sales percentage from the originally listed price.

In addition to the agreed upon price, additional costs such as shipping, customs/duties, and Taxes including VAT may be applied thereafter. All such costs will be clearly communicated to buyers before collecting payment.

If your offer is declined by the owner of the artwork, you agree that a curator may contact you to let you know and to help find similar works or facilitate a commission by the same artist.

You cannot apply any promotional discounts to your offer.

Artist resale payment:

Upon the sale of an original artwork, the artist will receive a notification by Email regarding the sale. However, the payment will be transferred to the artist’s officially submitted account after 7 working days following the delivery of the artwork. This delay is implemented to ensure that the artwork meets the purchaser’s satisfaction, such as ensuring that the work was not damaged.
